BlockSurvey Terms of Service

1. Terms

By accessing the website at https://blocksurvey.io/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

Users are granted a limited, non-exclusive right to access and use the Platform for lawful purposes, including but not limited to: creating and distributing surveys, collecting and analyzing responses, and accessing and utilizing the tools, reports, and features made available through the Platform. Users shall not use the Platform for any unlawful, unauthorized, or prohibited purposes. Without limitation, users agree not to: post, transmit, or otherwise make available any content that is false, misleading, defamatory, discriminatory, or that infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party; attempt to gain unauthorized access to the Platform or any related systems, networks, or data; use automated means, including but not limited to scripts, bots, or data scrapers, to extract or interact with the Platform; or collect, store, or process any sensitive personal data—such as health, financial, or biometric information—without obtaining the explicit, informed consent of the data subject and ensuring full compliance with all applicable data protection and privacy laws.

For the avoidance of doubt, You are and will remain the exclusive owner of all, right, title and interest in and to the Customer Data, including any Intellectual Property Rights relating thereto. "Customer Data" means all data, information, content, materials, and intellectual property of any kind submitted, uploaded, transmitted, or otherwise provided by Customer or Customer's end users through the Services including Your Confidential Information and the electronic data or information (including any personal data) submitted, provided, uploaded, transmitted, imported, displayed or otherwise made available by You through the information or software. BlockSurvey acquires no ownership rights in Customer Data. BlockSurvey may only access, process, or use Customer Data solely for the purpose of providing the Services to Customer during the term of this agreement. BlockSurvey must not:

  1. use Customer Data for any other commercial purpose;
  2. create derivative works from Customer Data for BlockSurvey's benefit; and
  3. retain Customer Data beyond 30 days after termination except as required by any applicable laws.

2A. Your Responsibilities

As a user of BlockSurvey, you acknowledge and agree that:

  1. You are solely responsible for maintaining the confidentiality and custody of your encryption keys and access credentials. BlockSurvey operates under a zero-knowledge architecture and does not have access to your decrypted data.
  2. You are responsible for ensuring the accuracy, legality, and appropriateness of the data you input, collect, or process through the platform.
  3. You must promptly notify BlockSurvey in the event of any unauthorized access, security breach, or compromise of your account or encryption keys.
  4. You must ensure your use of BlockSurvey complies with applicable data protection laws, including, where relevant, obtaining consent from respondents or users.
  5. You are responsible for configuring your forms, surveys, or integrations in accordance with legal or compliance requirements specific to your use case.
  6. You must ensure the security of your own devices, browsers, or systems when interacting with the BlockSurvey platform.

2B. Data Collection Responsibility

You, as the survey creator or account holder, are solely responsible for the content of the surveys you create using BlockSurvey, including the type of data you choose to collect from respondents.

You acknowledge and agree that:

  1. BlockSurvey is a zero-knowledge platform and does not access, review, or moderate the data collected through your surveys.
  2. You are responsible for ensuring that the collection and processing of any personal data (including but not limited to PII, PHI, or other regulated data) complies with all applicable data protection, privacy, and industry-specific laws (such as GDPR, CCPA, HIPAA, etc.).
  3. You must obtain any necessary consents from your respondents and provide all required notices and rights disclosures under applicable law.
  4. BlockSurvey disclaims all liability arising from your use of the platform to collect or process personal or sensitive information that violates legal, regulatory, or ethical obligations. In the event of a dispute or regulatory inquiry, you agree to indemnify and hold harmless BlockSurvey and its affiliates from any claims, penalties, or damages arising from your data collection practices.

2C. Data Hosting and Storage

By default, BlockSurvey stores all data securely on Google Cloud Platform (GCP) and render servers located in the United States.

For customers with specific regional data residency requirements, BlockSurvey offers the option to deploy and host data within the European Union (EU) upon request. Please contact us at [email protected] to enable EU-hosted deployment for your organization.

3. Disclaimer

While it is in BlockSurvey's interest to provide you with a great experience when using the services, there are certain things we do not promise about them. We try to keep our online services up and running, but they may be unavailable from time to time for various reasons.

Except as expressly provided in these terms and to the extent permitted by applicable law, the services and any guidance or recommendations therein are provided "as is." BlockSurvey does not make warranties of any kind—express, implied, or statutory—including warranties of merchantability, fitness for a particular purpose, or any representations regarding the availability, reliability, or accuracy of the services. The above disclaimers do not apply to BlockSurvey's obligations regarding Customer Data security, confidentiality, and proper handling as specifically set out in these terms.

4. Limitations

To the extent permitted by applicable law, BlockSurvey will not be liable for your lost revenues or indirect, special, incidental, consequential, exemplary, or punitive damages, even if BlockSurvey has been advised of, knew, or should have known that such damages were possible, and even if direct damages do not satisfy a remedy.

If you suffer loss or damage as a result of BlockSurvey's negligence or failure to comply with these Terms, any claim by You arising from BlockSurvey's negligence or failure will be limited in respect of any one incident, or series of connected incidents, to the Subscription Fees paid by you in the previous 12 months.

Subject to the above limitations, if you are not satisfied with the Service, your only remedy will be to terminate your agreement at any time with immediate effect by notifying us that you no longer wish to use our Services.

5. Accuracy of materials

The materials appearing on BlockSurvey's website could include technical, typographical, or photographic errors. BlockSurvey does not warrant that any of the materials on its website are accurate, complete or current. BlockSurvey may make changes to the materials contained on its website at any time without notice. However BlockSurvey does not make any commitment to update the materials.

6. Links

BlockSurvey has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BlockSurvey of the site. Use of any such linked website is at the user's own risk.

7. Modifications

BlockSurvey may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with BlockSurvey Inc., and laws of Delaware and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

9. Confidentiality & Privacy

Neither party will use or disclose the other party's Confidential Information without the other's prior written consent except for the purpose of performing its obligations under this Agreement or if required by law, regulation or court order; in which case, the party being compelled to disclose Confidential Information will give the other party as much notice as is reasonably practicable prior to disclosing the Confidential Information.

You will have and abide by an appropriate Privacy Policy that clearly dictates all your rights to your personal information and will comply with all applicable laws, policies, and regulations. You must not circumvent any privacy features (e.g., an opt-out) that are part of the Service.

10. Data Protection

We acknowledge that all intellectual property rights in Your Data are and will remain the property of You and/or the relevant Data Subjects, as the case may be; and that We shall have no rights in or to Your Data other than the right to Process it for the purposes set out in this Agreement. You reserve the right to access, modify, delete and transfer Your Data. Please refer to our DPA document to learn more about our Commitment towards your data.

You will access the above Website online, which will require You to accept a Terms of Service agreement, but this BlockSurvey Terms of Service shall govern the parties agreement for using the above website. In witness whereof, the parties have executed this BlockSurvey Terms of Service as of the data set forth below.

"Security Incident" means the actual or likely occurrence of:

  1. a breach by BlockSurvey (or its personnel) of its data security or confidentiality obligations under these terms; or
  2. an 'eligible data breach' (as that term is defined in the Privacy Act 1988 (Cth)) involving Customer Data; or
  3. any unauthorised access, use, disclosure, modification, or destruction of Customer Data; or
  4. any loss of Customer Data or compromise of data integrity.

In respect of any Security Incident, BlockSurvey must:

  1. notify the customer within 24 hours of becoming aware of the Security Incident;
  2. comply with its obligations under applicable privacy laws;
  3. provide customer with all information customer reasonably requests regarding the Security Incident;
  4. assist and fully cooperate with customer in investigating and remedying the Security Incident; and
  5. take any other action reasonably deemed necessary to remedy the Security Incident.

11. Data Retention

We retain user data for as long as necessary to fulfill the purposes described in this Privacy Policy, including compliance with legal, regulatory, or contractual obligations.

  1. Subscription Users: Upon termination of your license or subscription, we will retain your data for a period of 30 days. During this time, you may download, export, or delete your data. After this 30-day period, your data will be permanently deleted from our systems, unless a longer retention period is required by law.
  2. Free Plan Users: Data will be automatically deleted after six months of inactivity. Prior to deletion, we will send reminders via alerts and email notifications, including the final deletion date.
  3. User-Controlled Deletion: You may delete your data at any time through your account settings within the BlockSurvey platform. This includes survey responses, projects, and account information. Once deleted, the data is removed from our production systems and will no longer be accessible.
  4. Backups: Backup data may be retained securely for up to 90 days for disaster recovery purposes, after which it is automatically purged.

BlockSurvey acquires no ownership rights in Customer Data and will only process it in accordance with our Data Processing Agreement (DPA) and applicable privacy laws.
